Consent Decrees, Settlement Agreements

Voting 244 for and 173 against, the House on Jan. 12, 2016, passed a bill raising obstacles to the consent decrees and settlement agreements used by the Department of Justice and other agencies in enforcement actions against businesses alleged to have violated federal laws and regulations. The bill would apply in cases where the decree or agreement requires agencies to take specific regulatory actions as part of the remedy. Under the bill, agencies would have to meet cumbersome paperwork-filing and electronic-posting requirements before they could submit decrees or settlements for court approval, and courts would have conduct more detailed reviews of decrees and settlements submitted to them. And certain side disputes would be resolved through out-of-court mediation rather than by judges in open court.

Bob Goodlatte, R-Va., said the bill addresses "the problem of `sue and settle' regulation. Time and again, new, high-cost regulations are issued under consent decrees and settlement agreements that force federal agencies to issue new rules."

Elijah Cummings, D-Md., said the bill was "yet another attack by House Republicans on critical public health, safety and environmental protections."
